Jennifer Laoun-Rubenstein has a write up clarifying info on having professional artist status:

A Note on Professional Artist Status

I often hear fellow artists express doubts about their status as professional artists. Her is a quick guide that I hope clears things up!

For self-identification purposes, professional artists are people who:

• make art.

• exhibit their artwork publicly.

• are recognized to be an artist by other artists.

• earn money for the sale or display of their artwork.

Under Canadian law, the Status of the Artist Act stipulates a professional visual artist is also an independent contractor and member of an artists’ association. The only artist associations certified by the Canada Industrial Relations Board (CIRB) are: CARFAC (nationally) and its partner RAAV (Québec).

The benefit of obtaining membership from CARFAC or RAAV is that these associations are legally mandated to protect the rights of visual artists, and to negotiate legally binding agreements with federal institutions, in Canada and Quebec respectively. Both associations have all kinds of helpful resources, including suggested minimum artist fees, sample contracts and certificates, and more. They also offer member discounts at partner retailers and museums. Check out their websites for the full list of membership benefits.

Obtaining professional status from these associations eliminates the need to justify your status as a professional artist when applying for grants or subsidies by the Conseil des arts de Montréal, CALQ, and Canada Council for the Arts, for example.

Applicants looking for certified professional artist status, and who were refused by RAAV are able to apply to provincial chapters of CARFAC, the closest being CARFAC Ontario and CARFAC Maritimes.

Wishing you clarity, creativity, and success in your art careers! Jennifer Laoun-Rubenstein
